The domain name through which you accessed the platform is the property of Enrique Marco Montero. This domain name may not be used in connection with any content, products, and/or services not owned by Enrique Marco Montero, nor in any manner that may cause discredit or confusion among users.

You shall be liable to Enrique Marco Montero and/or third parties for any damages that may arise as a result of your failure to comply with the obligations set forth in this Legal Notice.

3. Exemption and limitation of liability

From our Platform, you may be redirected to content on third-party websites. Since Enrique Marco Montero cannot always control the content posted by third parties on their websites, Enrique Marco Montero disclaims any liability for such content. The Owner reserves the right to suspend or interrupt, at any time and without prior notice, access to the products, services and/or Content of the Portal, as well as the configuration of the Portal and its features, for maintenance, repair, updating, improvement and/or adaptation to technical, operational and/or legal changes, without the user being able to claim or demand any compensation.

Enrique Marco Montero shall not be liable under any circumstances for any loss, damage, or harm that may be caused by reasons inherent to the non-functioning or malfunctioning of the Platform or any websites to which links may have been established.

SPECIFIC TERMS AND CONDITIONS OF USE

1. Reservations

To make reservations through the Website, the User must provide their personal information (name, surname, email address, and telephone number), or, where applicable, the information of the person on whose behalf the activity is being reserved.

Under these General Terms of Use, Users declare that they provide true, accurate, current, and complete information about themselves, or, where applicable, about the person on whose behalf they are booking the activity. Users will therefore be responsible for the accuracy of the information provided and for any consequences that may arise from errors in the information provided.

2. Specific conditions regarding the reservation and execution of activities

Reservations made through the Website are subject to the specific terms and conditions applicable to each activity, excursion, or guided tour. These terms and conditions can be found on each activity's page, as well as in the confirmation email sent by Fan of Tours after making the reservation.

The meeting point, date, time, duration and all the necessary information to enjoy the reserved activity are detailed on each activity page.

Taking notes, photographs, or recording images or sounds of the tours is not permitted without prior authorization from Fan of Tours staff.

Out of respect for all attendees, the guide will start the tour punctually; it is your responsibility to be at the starting point on time.

The organization reserves the right to modify or cancel the tour and visit, admission to monuments, and scheduled times for fully justified reasons.

The duration of the activities published on the website is for reference purposes only and may vary slightly depending on the activity itself or external factors beyond the guide's control.

To guarantee your spot, you must arrive at the meeting point no later than 10 minutes before the tour starts. After that time, we reserve the right to reassign your spot to anyone else. This measure aims to be fair to all those interested in participating in the tour and ensure a punctual start time.

THEME TOURS are paid tours. Once your reservation is successfully completed, the ticket and confirmation will be automatically sent by email. If for any reason you do not receive this email, please contact us at info@fanoftours.com, as this may indicate that your order was not successfully processed. Please also check your spam folder before contacting us.

You must print your booking voucher or show it from your mobile phone or tablet, and present it along with a valid photo ID before the tour begins. While we will do our best to verify the reservations of those who show up without a valid printed ticket, we cannot guarantee it. In this case, you will need to purchase a new tour ticket.

The tour includes the guide(s) and, where specified, may include transportation costs. Food, drinks, restroom use, incidentals, and any other items not specified in the tour description are not included in the tour price.

PRIVATE TOURS are paid tours with a guide exclusively for you and your companions. Food, drinks, restroom use, incidental expenses, and any other aspects not specified in the tour description are not included in the tour price. The tour guide will be reserved only for the time period indicated in the booking description. If the group arrives more than 10 minutes late, the wait time will be reduced from the agreed-upon tour duration.

Participation in Fan of Tours tours is strictly voluntary, and both the freelance guide and Fan of Tours reserve the right to deny participation to anyone for any reason at any time.

As with any human activity, there is a level of risk. However, at Fan of Tours, we do everything possible to keep that risk to a minimum. Neither Fan of Tours nor the independent guides who provide the services advertised by Fan of Tours accept any responsibility for damage to your person or property during the tour.

3. Cancellation Policy

Each service will have its own specific cancellation policy, which will establish the cancellation period and whether or not there are any penalties, which will be displayed on each activity's page.

As a general rule:

The purchaser has the right to request a refund within 7 calendar days of the purchase date. In the event of changes to the itinerary or duration of the visit due to reasons beyond the organization's control, no changes or refunds will be issued.

Fan of Tours reserves the right to accept or reject a purchase for any reason, including, but not limited to, unavailability of a reservation, an error in the price or description or image of the service or product, or any error in the purchase.

Failure to attend the contracted service, late arrival, non-attendance at the activity, or an error in the purchase process will not be valid reasons for a refund. When purchasing your ticket, please check that the visit, date, and time are correct, as changes or refunds will not be accepted, except for reasons not attributable to the client.

In the event of adverse weather conditions requiring the involuntary cancellation of the activity, a new date will be scheduled.

In the event of a visit being canceled for reasons not attributable to the client, the tour will be replaced with another tour of the same price, which the user may choose, provided there are available spots. If a change is not possible, the client will be offered the option of initiating the administrative process for a refund.

IN ACCORDANCE WITH THE FOREGOING, AND BY ACCEPTING THESE GENERAL CONDITIONS OF USE, USERS DECLARE THAT THEY HAVE READ AND EXPRESSLY ACCEPTED THIS CANCELLATION POLICY AND AGREE WITH THE CANCELLATION CONDITIONS OF THE ACTIVITY, EXCURSION, GUIDED TOUR AND/OR TRANSFER THEY BOOK THROUGH THE WEBSITE.

4. Opinions

Users who have booked activities will receive an email when the activity is complete so they can rate the experience and service provided.

5. Exclusion of liability

By way of example, but not limited to, Fan of Tours is not responsible for the following circumstances:

i. Late cancellations by Users. Fan of Tours will not be responsible under any circumstances for refunding amounts paid by its Users if they have not complied with the cancellation deadline specified in the cancellation policy applicable to each service.

ii. Delays or errors made by Users in reaching the meeting point for the reserved activity, excursion, guided tour, and/or transfer.

iv. Damage and theft affecting Users and their property during the enjoyment of activities, excursions and guided tours and/or during the journey of the contracted transfer service.

v. Of any injuries, damages, and accidents that the User may suffer while enjoying the reserved activity, excursion, guided tour, and/or transfer, as well as any injuries, damages, and accidents suffered by the User prior to the service and which prevented them from enjoying it.

viii. The weather conditions under which the activities, excursions, and guided tours booked by Users are carried out. Under no circumstances will it be responsible for these circumstances, and the service will therefore be deemed to have been properly provided.

6. Modifications

Enrique Marco Montero reserves the right to make any changes it deems appropriate to these General Terms of Use, in which case it will notify Users in advance. These changes will be effective upon publication on the Website.

7. Safeguard clause

All clauses or provisions of these General Conditions of Use must be interpreted independently and independently. The remaining provisions will not be affected if one of them is declared invalid by a final court ruling or arbitration decision. The affected clause or clauses will be replaced by one or more clauses that preserve the intended effects of the General Conditions of Use.
